Dans ce cas, les parties ont une relation de confiance, et d&rsquo;un point de vue juridique, les activit\u00e9s de celui qui a le pouvoir engagent celui qui l&rsquo;a donn\u00e9e. Sans une procuration officielle sign\u00e9e, personne ne pourra agir juridique au nom d\u2019une tierce personne, qu\u2019il soit avocat ou un simple particulier. Cet article de Maitre Alex Brosh, donne quelques explications au sujet de la procuration et de son utilisation.<\/p>\n<h3 dir=\"ltr\">Qu&rsquo;est-ce qu&rsquo;une procuration ?<\/h3>\n<p dir=\"ltr\">Le mandat joue un r\u00f4le important dans nos vies et est utilis\u00e9e dans divers domaines du droit, que ce soit la repr\u00e9sentation au tribunal, le pouvoir d&rsquo;effectuer divers types d&rsquo;actions juridiques ou encore la signature de transactions immobili\u00e8res.\u00a0 Il y a des questions o\u00f9 le mandat pour une action en justice est limit\u00e9e \u00e0 l&rsquo;avocat. Par exemple, seul un avocat peut repr\u00e9senter une personne au tribunal. D&rsquo;autre part, il y a des cas l&rsquo;on peut donner procuration toute autre personne, et dans ce cas la procuration devra \u00eatre authentifi\u00e9e par un notaire. Un pouvoir sign\u00e9e \u00e0 l\u2019\u00e9tranger exige une traduction notari\u00e9e en h\u00e9breu et un document public d&rsquo;authentification.<\/p>\n<p dir=\"ltr\"><img decoding=\"async\" class=\"wp-image-13459 aligncenter\" src=\"https:\/\/script_transfer_new.mowfns.ap-southeast-2.wpstaqhosting.com\/wp-content\/uploads\/2013\/12\/aop1-11.jpg\" alt=\"procuration\" width=\"268\" height=\"178\" \/><\/p>\n<h3 dir=\"ltr\">Quelle est l&rsquo;importance de la procuration pour une action en justice ?<\/h3>\n<p dir=\"ltr\">L&rsquo;importance de la d\u00e9l\u00e9gation de pouvoirs peut \u00eatre d\u00e9montr\u00e9e au moyen d&rsquo;un cas que nous avons trait\u00e9. Lors de l&rsquo;audience au tribunal, la partie adverse ne s&rsquo;est pas pr\u00e9sent\u00e9e, et \u00e0 sa place est venu un avocat qui pr\u00e9tendait qu&rsquo;il \u00e9tait autoris\u00e9 pour le repr\u00e9senter devant le tribunal. Nous avons eu l&rsquo;occasion d&rsquo;examiner la procuration, et nous savions qu\u2019elle ne concernait qu\u2019un seul avocat, que nous avons eu le temps de conna\u00eetre. Seul cet avocat avait le droit de repr\u00e9senter la partie adverse \u00e0 la cour, et l&rsquo;avocat de remplacement n&rsquo;\u00e9tait pas autoris\u00e9 \u00e0 b\u00e9n\u00e9ficier de ce m\u00eame droit. Nous avons donc demand\u00e9 au juge de d\u00e9clarer la non-pr\u00e9sence de la partie adverse, avec toutes les cons\u00e9quences juridiques que cela pouvait avoir.<\/p>\n<h3 dir=\"ltr\">Procuration r\u00e9guli\u00e8re par rapport \u00e0 une procuration irr\u00e9vocable<\/h3>\n<p dir=\"ltr\">La d\u00e9l\u00e9gation de pouvoirs r\u00e9guli\u00e8re (ou encore g\u00e9n\u00e9rale) s&rsquo;annule automatiquement dans les cas suivants :<\/p>\n<ul>\n<li dir=\"ltr\" style=\"text-align: left;\">La mort de l&rsquo;une des parties<\/li>\n<li dir=\"ltr\" style=\"text-align: left;\">La perte de la capacit\u00e9 juridique de l&rsquo;une des parties<\/li>\n<li dir=\"ltr\" style=\"text-align: left;\">La faillite de l&rsquo;une des parties<\/li>\n<li dir=\"ltr\" style=\"text-align: left;\">L&rsquo;annulation du mandat par chacune des parties.<\/li>\n<\/ul>\n<p dir=\"ltr\">La procuration irr\u00e9vocable sert \u00e0 assurer la protection des droits de la personne autoris\u00e9e ou du tiers autoris\u00e9, et ces droits d\u00e9pendent de la t\u00e2che accomplie par le possesseur de la procuration. Par cons\u00e9quent, ce type de procuration ne peut pas \u00eatre annul\u00e9e dans les cas cit\u00e9s ci-dessus.<\/p>\n<p dir=\"ltr\">Une autre diff\u00e9rence entre une procuration r\u00e9guli\u00e8re et une procuration irr\u00e9vocable est le fait que pour une procuration r\u00e9guli\u00e8re, il n&rsquo;est pas permis d&rsquo;effectuer une action juridique, dont l&rsquo;entr\u00e9e en action d\u00e9pend de l&rsquo;inscription dans un carnet particulier, apr\u00e8s que soit pass\u00e9es 10 ann\u00e9es \u00e0 compter de la date de signature.<\/p>\n<p dir=\"ltr\">Dans ces cas, il faut obtenir le consentement \u00e9crit de la personne qui donne la d\u00e9l\u00e9gation de pouvoirs, mais m\u00eame dans ce cas, le pouvoir n\u2019est valide que pour une ann\u00e9e suppl\u00e9mentaire, \u00e0 partir de la date d&rsquo;acceptation de l&rsquo;accord.
